Part I. General

By accessing this site, the user declares to have read, understood and accepted the Terms of Use described below, without the need for any subsequent action or consent.

 

1. SITE CONTENT AND INTELLECTUAL PROPERTY

 “Site content” refers to all information on this site, including, but not limited to, brands, designs, logos, texts, images, photos, illustrations, audio or video materials, web design and software.

The intellectual property rights of all content on this site that are not externally supplied and as such are duly identified, belong to their authors and are protected under general terms of law and by national and international legislation for the protection of intellectual property, copyright and related rights, as well as by the law on computer crime.

It is expressly prohibited to copy, alter, reproduce, display, disseminate, distribute, transmit or use the contents of this site, in any form or for any purpose without the prior express authorization of its authors, except for teaching or research purposes or for personnel use, in which case their ownership must be indicated.

IPTI® authors reserve the right to take legal action against those responsible for unauthorized copying, reproduction, dissemination, commercial exploitation or any other improper use of the site content.

 

In Portuguese law, the rule applicable to the protection of intellectual property is found in Decree-Law no. 143/2014 of 26 September (Decreto-Lei n.º 143/2014 de 26 de setembro).

2. SECURITY

IPTI® authors are committed to: 

1) ensure the security and privacy of personal data;

2) comply with Regulation (EU) 2016/679 of the European Parliament and the Council of 27 April 2016 – RGPD – and other applicable legislation, including complementary national RGPD legislation.

 

2.1. Type of personal information stored

When browsing and interacting with the site, information about users’ device and navigation is automatically collected through cookies, web beacons or similar technologies, such as the ip address, which may be classified as personal data.

Other personal data is collected only with the consent of the user of the site. To access more information, download content or request a contact, some personal information is required, by completing a form whose data to be filled out include:

  1. about the user: name, email address, telephone contact, taxpayer number, address;
  2. about the company to which it belongs (if applicable): name, position held by the user in the company; number, address, and other company information (if necessary).

Personal information may also include information about publicly available users on the Internet, i.e. on social networks or other service providers.

When the user of the site identifies himself, providing an email address, information is collected such as: information about his/her device and visits to the IPTI® site that may include (but not limited to) IP address, browser information, reference source, geographic location, devices used, pages visited and duration of the visit.

 

2.2. Non-personal information collected from other sources

While the user browses the site, non-personal data (e.g. number of visits, average time spent on the site, pages viewed) may be collected from other sources without the need for a formal registration. This data, combined with personal data provided by the user, helps create a more personalized offer and communication and a better user experience.

 

2.3. Processing of navigation and usage information

This site uses web beacons. These can, for example, be placed in marketing emails, so that when the user clicks on the link in the email, it is directed to the site. Such tracking technologies are used to operate and improve the site and communication in addition to tracking the click of links or the opening of emails.

The site stores data on the user’s computer in the form of a “cookie” so that the user’s device can be recognized on the next visits to the site. Cookies can be useful as they adapt the experience to the user’s interests. However, if the user does not want cookies to be stored on their computer, their browser can be configured to delete, block or even warn them before cookies are stored.

The IPTI® site uses the Google Analytics tool for tracking purposes, helping to provide a more relevant web experience for users.

The Google Analytics cookie collects information about: the user’s home site, the number of visits by individual users, the time spent on the IPTI® site, among others. The data is not recorded at the individual user level; it is only used to create aggregated web statistics.

If the user wishes to block or reject cookies set by the IPTI® site, he/she can do so by modifying his/her browser settings.

 

2.4. Use of information

The personal data provided by the user allows IPTI® to answer users` questions, requests and maintain user-site contact.

IPTI® does not share, sell or rent any personal information about users of the site to third parties. No information provided will be used for purposes other than those related to IPTI®.

The information (personal and use of the IPTI® site) collected is used to:

  • personalize the experience of users on the site and other IPTI® digital channels;
  • send relevant information to users via email, social networks and other channels;
  • satisfy contact requests and improve communication;
  • analyze trends, monitor the use of the site and interaction with e-mails, aiming at the continuous improvement of the site and the communication of content more effectively;
  • conduct marketing research, advertisements, provide personalized information about IPTI® and its e-learning courses and other personalized content based on the user’s activities and interests, provided that he/she has given his/her prior consent for his/her personal data to be used for marketing purposes.

 

2.5. Use limitations

IPTI® will collect, use or disclose personal data provided by the user electronically only for the purposes disclosed, unless:

  • it is necessary to communicate to government or legal authorities;
  • it is necessary to preserve a legal claim;
  • it is necessary to prevent fraud and other illegal activities that compromise the information technology systems of the IPTI® site;
  • there is another additional purpose related to the original purpose for which the data was collected.

 

2.6. Security limitations and constraints

Without prejudice to the IPTI® commitment of confidentiality of personal data and the application of security measures against the intrusion of unauthorized strangers, users of this site declare that they are fully aware of the characteristics and constraints, limitations and defects of the Internet, and in particular that the transmission of data and information via the Internet, circulating in heterogeneous networks of various technical characteristics and capabilities, benefit only from relative technical reliability. These constraints may disturb or derail user access at certain times.

Users acknowledge, and accept to run the risks inherent in internet browsing, i.e. to recognize that any site is subject to intrusion by unauthorized third parties and may, consequently, be interrupted; whereas information circulating on the Internet is not protected against any viruses and/or deviations (free access); and that anyone is likely to create a link with access to the site and/or to elements contained therein. IPTI® authors may in no case be liable for accidental or voluntary damages suffered by users and caused or not by third parties in connection with the use of the services provided on this site or elsewhere on the Internet to which they have had access through it.

IPTI® authors are not responsible for any damage that may be caused by the use of the service, including virus contamination.

Without prejudice to the privacy policy (which should be had as an obligation of means) regarding the use of personal data, IPTI® authors warn that there are risks related to the Internet and databases, and it is possible that the personal data contained in the portal can be captured and/or transferred by third parties, particularly in countries where the protection systems of personal databases are still in poorly developed stages and where protection is scarce and/or ineffective. Users accessing this site agree to take the risks inherent in their activity as an internet user, namely the risk of possible transfer of open data.

 

3. CONTENTS AND RESPONSIBILITY

The information on this site has been included in good faith and is intended solely for the direct information of the user, its use being its sole responsibility.

The IPTI® authors, without prejudice to compliance with the rules on the protection of personal data, reserve the right to make changes and corrections, suspend, interrupt or close the site when deemed appropriate, without the need for prior notice and for the period deemed necessary, for any technical, administrative, force majeure or other reasons, and cannot be held responsible.

IPTI® authors are not responsible, nor can they be held responsible, for the hyperlinks existing in their service to third party sites. These hyperlinks are provided solely for the convenience and accessibility of the user, and the IPTI® authors are not responsible for the content of these third party sites, their access and visit being the sole responsibility of the user.

IPTI® authors are not yet responsible for the privacy policies of third party sites, and any links that may exist do not imply acceptance of the respective contents or an association with their owners by the IPTI® authors.

IPTI® authors can update the terms of use and privacy policy, following changes arising from the development and technological advances of the Internet itself, as well as legislative changes in this area.

IPTI® authors do not assume responsibility or obligation for any action or content transmitted by or between the user and or any third parties inside or outside this site and despite being aware of the editorial content, they do not and cannot exercise control over all messages.

IPTI® authors are not responsible and cannot be held responsible for the veracity and accuracy of the data or content placed directly by the user on the site to which the entire responsibility will fall.

The user agrees not to transmit to this site any illegal, threatening, insulting, racist, discriminatory, accusatory, defamatory, offensive, obscene, scandalous or pornographic content, or any other content that may constitute or encourage conduct that calls for violence and illicit acts. IPTI® authors reserve the right to delete any message with this content.

The user also undertakes not to carry out any operations that may impair the functioning of the site or to access an area/account and its contents without the respective authorization, to test, assess or break the vulnerability of the installed security, to install or attempt to install viruses or programs that damage and/or contaminate it, trigger or attempt to trigger “denial of service” attacks or advise third parties to do so.

The use of the site for illegal purposes or any other purpose that may be considered harmful to the image of IPTI® is expressly prohibited.

The user of this site agrees to defend, indemnify and hold the IPTI® authors liable for and against any claim or demand made by any third party, as well as all associated obligations, damages, costs and expenses (including, without limitation, reasonable attorney fees) arising from and/or related to the use of this site by the user, contents transmitted by him/her to this site, violation by the user of any third party rights and/or violation by the user of the Terms of Use.

 

4. JURISDICTION

The specified Terms of Use and Privacy Policy will be governed and interpreted in accordance with Portuguese law.

The user irrevocably accepts the jurisdiction of the Portuguese courts to settle any conflict arising and/or related to the Terms and Conditions, the Privacy Policy and/or the use of this site.

The user agrees to submit all possible disputes that may result from their use to the Lisbon Consumer Conflict Arbitration Center, which will judge according to Portuguese Law, in compliance with Law No. 144/2015, of 8 September.

REGULATION and TERMS AND CONDITIONS – ONLINE TRAINING IPTI®

 

1. THE PURPOSE OF THIS REGULATION IS TO DEFINE THE GENERAL OPERATING STANDARDS FOR E-LEARNING TRAINING COURSES DEVELOPED BY IPTI® WITHIN THE SCOPE OF FUNDEC®.

 

1.2. IPTI® is a national trademark registered with Nº. 000000 at the National Institute of Industrial Property (INPI), under which Ana Tomé (CERIS, DECivil, IST, UL) and Jesse Rafeiro (CIMS, Carleton University) disclose and share their research in the scientific area HBIM (Historic Building Information Modeling). 1.5. The use of IPTI® / FUNDEC® training services implies full acceptance and agreement by the trainees with the terms and conditions set out in the regulation described below, as well as acceptance of the FUNDEC® Terms and Conditions.

 

2. IPTI® ONLINE PEDAGOGICAL MODEL 


2.1. IPTI® courses have their own pedagogical model based on the experience resulting from the research developed by IPTI® researchers and collaborators. The knowledge acquired is systematized according to practical exercises applied to real case studies. 

2.2. Temporal flexibility: the trainee benefits from access to the contents of the courses anywhere and at any time, depending on his / her availability and pace of learning.

2.3. Autonomy: the trainee is responsible for carrying out the self-study of the contents made available on the platform during the defined deadlines.

2.4. Training is based on interactions between trainees and pedagogical resources. 

 

3. SINGLE AND INDIVIDUAL USE


3.1. Registration as a Client on the IPTI® platform, and any enrollment related to registration, is individual and non-transferable and can only be enjoyed by the Client / Trainee.

3.2. The Username (Login) and the Access Password can only be used, solely and exclusively by the Client / Trainee and cannot be provided or used by other individuals or entities.

3.3. All written communications sent to the Client / Trainee’s electronic address are intended solely and exclusively to the Client / Trainee and may not be copied, reproduced, consulted or made available to third parties. 

3.4. The Client / Trainee recognizes that all texts, images and other interactive resources made available on the IPTI® platform within the scope of Training are intended solely and exclusively for the Client / Trainee, so they cannot be made available to another individual and / or entity, even who has paid the cost of attending the course. However, the Client / Trainee can request the billing of services to third parties, who are responsible for paying the subscriptions.

3.5. The Client / Trainee may record and / or print the contents made available on the IPTI® training platform only for individual and exclusive use, and may not assign the contents to third parties, copy, reproduce or manipulate them in whole or in part or use them for commercial, advertising or third party training, without prior authorization from IPTI®.

3.6. The Client / Trainee recognizes that all their accesses and movements on the IPTI® platforms are monitored and recorded.

 

4. ADVERTISING OF THE COURSES


The e-learning courses are published on the IPTI® and FUNDEC® websites and presented by categories with a link to the technical file of each course and registration page.

5. REQUIREMENTS FOR USE OF THE IPTI® TRAINING PLATFORM


5.1. The use of IPTI® training services implies:

  • access to a computer with an internet connection (mobile or fixed)
  • a browser (program to browse) such as Internet Explorer, Mozilla Firefox, Google Chrome or Apple Safari, preferably updated with the latest versions.

5.2. The Client / Trainee must have basic skills in the field of ICT (Information and Communication Technologies).

5.3. The Client / Trainee must guarantee, before proceeding to enrollment, the existence of technical conditions necessary to attend a certain course, namely in terms of equipment, software, skills, mastery of Portuguese or English languages, among other specifications mentioned in the page of the course he / she wants to attend.

5.4. The Client / Trainee is responsible for all costs associated with computer equipment and Internet connection, namely the costs that he / she may incur to establish and use an Internet connection, as well as the costs of technical repairs. The pedagogical materials were designed to allow its use online without the need for printing on paper.

5.5. IPTI® is not responsible for problems of a technical nature (example: computer malfunctions, problems with firewalls, problems with Internet access, among others).

 

6. ONLINE REGISTRATION PROCESS

 

6.1. The Client / Trainee when registering on the IPTI® platform must fill in their data on the registration form with true information and declare it to be legally valid.

6.2. The Client / Trainee declares that – by accepting the general conditions of use – that the data filled out on the platform is true information concerning, solely and exclusively their own person.

6.3. The validation of the purchase order for one or more courses through the website www.ipti.pt assumes that the Client / Trainee has become aware of and accepts the General Conditions of Use (IPTI® and FUNDEC®).

6.4. After the purchase, the Client / Trainee will receive an automatically generated email through the IPTI® website to confirm the transaction.

6.5. If the data is not correct, the Client / Trainee may request the change of the data at no additional cost. This request must be made through FUNDEC® contacts.

6.6. The Client / Trainee can enroll in any course as long as he / she is of age and meets the entry criteria, when applicable.

6.7. Except in the cases indicated, the courses have no minimum or maximum number of trainees.

6.8. In the case of courses with a maximum number of participants, the trainees will be selected on a first-come, first-served basis according to the formalization of the registration.

 

7. PAYMENTS

 

7.1. After enrolling in a course and by accepting the conditions set out in this Training Regulation / Terms and Conditions, the Client can make payment using one of the following means: ATM, MBWAY and PayPal.

7.2. The Client when completing the registration must indicate the billing details and choose one of the payment methods. You should also confirm your personal data on your profile.

7.3. The Client is responsible for all fees charged by banks or financial entities that he / she uses to pay the registration fee.

7.4. The value of the courses is added to the VAT amount at the legal rate in force.

7.5. After paying the registration fee, the Client acknowledges that he / she can start the course according to his / her availability / need.

 

8. EXCHANGES

 

8.1. Exchange of courses: the client may exchange courses, for another of equal value or higher, provided that he / she has not yet accessed the contents of the classes. If the Client intends to exchange for a lower value course, the difference will not be refunded, remaining on credit to be used in future enrollments, with no associated term. The course change request must be sent to the email [email protected].

8.2. If the Client / Trainee does not attend the course on the chosen dates, for reasons totally unrelated to IPTI®, the Client / Trainee is not entitled to any refund or credit, being considered a withdrawal, losing any rights on the amounts paid.  

8.3. The Client acknowledges that the frequency of any training course, except for products marked as free, is dependent on full payment.

 

9. RESERVED USE OF TEXTS, IMAGES AND SERVICES

 

9.1. The texts, images, sounds, interactive services and other materials or services made available on the IPTI® e-learning platform, hereinafter referred to as content, are intended to be used for the exclusive purpose of attending IPTI® courses.

9.2. The Client / Trainee cannot use the IPTI® logo under any circumstances, even if it is within the scope of work carried out in the courses he / she attends at IPTI®.

9.3. In the case of publishing online work carried out within the scope of the IPTI® courses that the Client / Trainee attends, and if he / she intends to use the name IPTI®, in an abbreviated and/or extended way, the Client / Trainee must mention “this work was carried out by the trainee (name of Client) within the scope of the course (course name) of IPTI® and is the sole responsibility of its author ”, thus assuming all responsibility for its content and dissemination and exempting IPTI® from any responsibility.

9.4. All content made available on or by IPTI® is the property of IPTI® and / or entities or individuals that are partners of IPTI® and cannot be copied, reproduced, quoted or manipulated, in whole or in part.

 

10. RULES OF CONDUCT


10.1. The Client / Trainee agrees to be governed by rules of conduct of good education according to the customs and practices of Portugal and undertakes to address and interact with collaborators, trainers and other IPTI® clients, in a correct and polite manner.

10.2. IPTI® reserves the right to edit or remove any messages from the Client / Trainee if they are offensive or outside the course materials and reserves the right to suspend the use of the service by the Client / Trainee if this practice is repeated or considered serious.

The Client / Trainee acknowledges that he / she is prevented from:

  • Posting on unsolicited commercial messages (spam), messages not related to the course topics, complaints, personal requests or messages that disrupt pedagogical activities and good practice on any social interaction tools used in the courses formative environment;
  • Collect information about other Clients / Trainees including, but not limited to name, telephone and e-mail address, without prior authorization from the Clients / Trainees targeted and from IPTI®;
  • Create a false identity, impersonate another person or try to deceive other clients, trainers IPTI® or who collaborate with IPTI®;
  • Transmit any material that may be protected by patents, copyrights or other forms of intellectual property protection and for which the Client / Trainee have no rights of transmission or use;
  • Transmitting viruses or any other type of destructive, harmful code that can cause damage to third parties.

 

11. FREQUENCY CONDITIONS OF E-LEARNING TRAINING 


11.1. To attend an e-learning course, the Client / Trainee must register on the website. After registration, including payment, IPTI® sends the Client / Trainee access data to its e-learning training platform by email.

11.2. After entering the IPTI® e-learning platform, the Client / Trainee will have access to it at any time of day or night, including weekends and holidays, within his / her user area, where he / she will find the courses acquired and all the supporting documentation.

11.3. Once the course has started, the Client / Trainee has access to it 24 hours a day, from the first day of the course until 11:59 pm on the last day of the training.

11.4. During the course period, it is the responsibility of the Client / Trainee to attend the same, and perform the proposed exercises.

11.5. Course extension up to 5 days: during the course attendance and within a maximum period of 24 hours after the course ends, the Client / Trainee can request an extension of the term of access to the course for 5 consecutive days, without incurring any cost. To take advantage of this measure, the Client / Trainee has to formalize his / her request, by email ([email protected]), to the IPTI® team. This request can only be made once.

11.6. The Client / Trainee acknowledges that there may be failures in accessing the IPTI® platform, namely for technical updating of the site, planned or not, and that he / she is only entitled to compensatory measures if those failures continue for more than 48 consecutive hours, or interpolated, for an equivalent time throughout the course.

11.7. IPTI® will make every possible effort to maintain the correct functioning of the e-learning platform, seeking to guarantee its accessibility 24 hours a day, 7 days a week. However, IPTI® is not responsible for any technical failures or difficulties in operation, depending on factors beyond its control and external to it.

 

12. PROTECTION OF PERSONAL DATA


12.1. The personal data provided by the Client / Trainee in the registration form and / or IPTI® communications are protected by the legislation in force and are strictly necessary to identify to the Client / Trainee.

12.2. The confidentiality and security of all information provided by the Client / Trainee is guaranteed, which is intended exclusively to be used for training purposes and administrative procedures related to payments, issuing and sending receipts, certificates and other documents.

 

13. COMPLAINTS AND SUGGESTIONS

 

13.1. Complaints / suggestions can be formalized and sent, by email ([email protected]), to the IPTI® team.

13.2. In the case of a suggestion, it will be evaluated by its contribution to the continuous improvement of IPTI® courses. In the case of complaints, after their validation, corrective and preventive measures will be decided upon and adopted in the future.

 

14. FREQUENCY CERTIFICATE


14.1. After the course, the Client / Trainee is entitled to a certificate of attendance, in digital format, issued by FUNDEC – Associação para a Formação e Desenvolvimento em Engenharia Civil e Arquitectura®

14.2. The Frequency Certificate will be issued in Portuguese or English according to the preference of the Client / Trainee.

 

15. GENERIC DESCRIPTION OF THE TECHNICAL-PEDAGOGICAL TEAM


15.1. Trainees

The Trainees are individuals who attend a Training action, during a certain period of time, with the objective of acquiring knowledge about HBIM workflows.

 

Trainees’ Rights:

  • Receive training with quality and in accordance with the objectives, methodology, program and timetable established for the respective course;
  • Have access to didactic resources and equipment necessary to attend the course, depending on the agreement;
  • Receive at the end of the course, a Certificate proving attendance;
  • Participate in the evaluation of the course, by completing the respective questionnaire;
  • Submit to the IPTI® team any complaints, suggestions or testimonies about the course attended.

 

Trainees’ Duties:

  • Do not disturb the normal functioning of the IPTI® e-learning platform; 
  • Ensure the conservation and proper use of the IPTI® e-learning platform;
  • Refrain from the practice of any act from which injury or discredit may result to IPTI®;
  • Inform, with truth, IPTI® about all anomalous occurrences at the course;
  • Provide all the information requested by the IPTI® team with truth;
  • Behave politely and respectfully in relationships with trainees, trainers and other collaborators of IPTI®.

 

15.2. Trainers / IPTI® Team:   

Qualified individuals, holders of specific academic and professional qualifications, responsible for the design and management of IPTI® courses.

 

Rights of Trainers / IPTI® Team: 

  • Access the results of the course evaluation carried out by the trainees;
  • Respond / oppose any information, assessment or complaint that arises from their performance or action taken by them.

 

Duties of Trainers / IPTI® Team: 

  • Develop the courses, in terms of planning, execution and evaluation;
  • Select, elaborate and make available the pedagogical materials to support the training action;
  • Whenever necessary, open and close the courses;
  • Ensure the smooth running of the courses, as a promotion of a good IPTI® image and as a contribution to the satisfaction of Clients / Trainees;
  • Manage the resources allocated to the courses;
  • Promote review and continuous improvement actions of the courses.

 

16. GENERAL PROVISIONS


16.1. These General Conditions of Use, when accepted by the Client, take the form of a contract between the Client and the IPTI® team.

16.2. The IPTI® team reserves the right to terminate the contract at any time, if the Client violates, threatens to violate or demonstrates that he / she does not intend to comply with the Conditions set out in this Regulation, without the right to any compensatory measure or compensation.

16.3. Even if the Client waives the exposed Terms and Conditions, the Client acknowledges that he / she may be held liable for violations of copyright, offenses, debts and for all the consequences that may arise – directly and indirectly – from the misuse of the IPTI® service and its content, violation of rules of conduct, improper and unauthorized use of reserved texts, images and services and registration data of other clients. This possibility of accountability remains even after the end of the relationship between Client and IPTI®.

16.4. This contract, as well as any interpretation or dispute related to it, is governed by Portuguese law.

16.5. Any doubts regarding the provisions contained in this Regulation can be clarified with the IPTI® Team, via the Internet to the email address [email protected]

16.6. Any situation that is omitted in this regulation will be interpreted by the IPTI® Team.

16.7. All trainees, trainers and other training, stakeholders are entitled to consult this regulation.
